Parole in Place

Military Parole in Place for Service Members and Families

Military families can face immigration problems even while a loved one is serving or has served the United States. Parole in place is a discretionary immigration option that may be available to certain people who are present in the United States without admission and who have a qualifying military connection.

An approval can be important because a person paroled into the United States may satisfy the admission-or-parole requirement for adjustment of status in some immediate-relative cases. It does not automatically grant a green card, erase every immigration violation, or waive every ground of inadmissibility.

Capital Gateway Immigration evaluates military parole in place together with the family petition and permanent-residence strategy that may follow.

What is Parole in Place?Who May Have a Qualifying Military Connection?
USCIS guidance provides a case-by-case process for certain current or former service members, enlistees, and qualifying family members. Depending on current policy and the facts, the relevant military connection may involve:

-An active-duty member of the U.S. armed forces
-A member of the Selected Reserve of the Ready Reserve
-A person who previously served in active duty or the Selected Reserve and was not dishonorably discharged
-A qualifying spouse, widow or widower, parent, son, or daughter of a current or former service member

The exact category and evidence should be checked against the USCIS guidance in effect when the request is prepared.

What Parole in Place Can and Cannot Do
If granted, parole in place generally authorizes the person’s presence for a temporary period and may create a parole record that is relevant to adjustment of status. It is discretionary and decided case by case.

-Parole in place does not by itself:
-Create lawful permanent residence
-Approve a family petition
-Guarantee adjustment of status
-Waive criminal, fraud, prior-removal, unlawful-reentry, or other inadmissibility issues
-Automatically provide employment authorization in every situation
-Prevent USCIS from reviewing the person’s complete immigration history

The value of parole depends on the legal obstacle it is meant to address. A full analysis should consider entries, exits, prior orders, arrests, applications, and statements to immigration officials.

Evidence for a Parole in Place Request
A request generally includes the current USCIS form and supporting evidence. Depending on the case, the record may include:

-Proof of the service member’s current or former military service
-Proof of the qualifying family relationship
-Identity documents
-A detailed statement explaining the request
-Evidence of family responsibilities and hardship
-Medical, financial, educational, or caregiving records
-Evidence of positive discretionary factors and community ties
-Certified criminal records, when applicable, with a legal analysis of their effect

USCIS may require biometrics, an interview, or additional evidence.

Parole in Place and Adjustment of Status
Many parole in place cases are part of a broader family immigration plan. For example, the immediate relative of a U.S. citizen may be able to pursue adjustment of status if the person was admitted or paroled and satisfies the remaining statutory requirements.

That analysis is separate from the parole request. An approved parole document does not resolve all adjustment questions. The family relationship, visa availability, admissibility, prior removal history, and other bars must still be evaluated.

Other Discretionary Options for Military Families
USCIS also describes deferred action and other discretionary options for some military-related cases. The correct request depends on the person’s history, current policy, and immigration goal. A family should not assume that the same benefit applies to every relative or every type of service.
