Executive Action

On November 20, 2014, President Obama announced he would be taking executive action on our broken immigration system. While the details are not final, we have a framework of what this action will look like.

Defered Action for Parental Accountability (DAPA)

Undocumented parents of US Citizens or Lawful Permanent Residents will be able to take advantage of a “DACA” like program giving them a work permit and protection from removal for a set period of time.

Program Requirements:

  • Have a US Citizen or Lawful Permanent Resident child (green card) as of November 20, 2014. Children with DACA do not qualify the parent. Unborn children do no qualify the parent.
  • Have continuously resided in the United States since January 1, 2010.

Expansion of Deffered Action for Childhood Arrivals (DACA)

This pre-existing program has been modified to include more individuals. If you were not DACA eligible in the past, new guidelines mean that now you could be.

  • Removed the requirement that applicants must have been born after June 15, 1981.
  • Must have entered the United States prior to your 16th birthday.
  • Applicants must have been present in the United States since January 1, 2010. This increased the previous date of June 15, 2007.
  • You must be in school or have graduated from high school in the United States or have a GED.
  • Do not have three misdemeanors or one serious misdemeanor (such as a DUI or Domestic Violence).

Other

There are other items that have been announced but no additional details have been provided. We are waiting for guidelines and regulations before action can be taken.
